Please read it carefully as this is the official policy in force at the present time. The policy listed below supersedes any other written document you may have received prior to today's date. 1. Training Courses / Events
Obligations of the Course Participant / Individual attending an eventThe course/event participant shall be responsible for choosing a course/event that corresponds to his or her abilities/requirements. The course/event participant undertakes to attend the course/event personally, to arrive punctually and to take part in the course/event. Delegates are welcome to send a substitute, provided that Dementia SA is notified for administration/certification purposes
Should the irregular attendance or other behaviour of the participant lead to a disturbance of the course/event for other participants, Dementia SA reserves the right to expel the participant from the course/event. In such an event the course/event fees shall not be refunded in any way, not even on a pro-rata basis.
Withdrawal/Cancellation Prior to the Start of the Course / EventThe contracting party may send written notification of withdrawal prior to the start of the course/event, without any statement of reasons. If such written notification is received by Dementia SA 14 working days before commencement of the course/events, all payments already made to Dementia SA shall be refunded to the contracting party. The reimbursements will be made within 4 weeks after reception of the withdrawal.
No-show / Withdrawal from the Course/EventShould the participant fail to show up for the course/event or withdraw from the course/evemt, he or she shall not be entitled to claim any reimbursement.
Incomplete ParticipationShould the participant not take part in all of the lessons that make up the subject matter of the course/event, he or she shall not be entitled to claim any reimbursement of payments already effected.
PaymentsFees may be paid by Cheque or Direct Transfer via the Dementia SA Pay Portal. Payments must be received in full prior to the commencement of the course/event. Admissions to the course/event will be subject to payments received
DeclarationI declare that all the particulars furnished by me on the on the Online Booking Form are true and correct.
I also declare that by clicking submit to this form I agree that I am applying for the specific course/event and that I will be responsible for the resulting financial responsibility
I agree that Dementia SA shall be entitled to recover all legal costs incurred in order to enforce its rights under this contract including but not by way of limitation attorneys and own client fees and collection and tracing charges
2. Refunds Generally
Save for certain exceptional cases (as listed below), Section 44 of the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act") entitles you to cancel any sale concluded on this Website within 7 days after date of receipt of the goods and to obtain a full purchase price refund within 4 weeks of returning the goods, in its original packaging and condition, to Dementia SA.
Section 42(2) of the ECT Act sets out all the exceptions to the aforesaid cancellation of goods. The exceptions include the following products in respect of which NO cancellation of goods shall apply:
Products which by reason of their nature cannot be returned or are likely to deteriorate or expire rapidly. You will only be entitled to a refund in respect of the exceptions listed above in the event and to the extent that any such refund is provided for under the express provisions of this Refund Policy herein below.
Late deliveryIf a product purchased is not delivered within the agreed delivery period, or where no specific period was agreed, within 4 weeks after having purchased the Product, the ECT Act entitles you to cancel such sale on 7 days notice to the seller of such product by phoning the National Helpline 0860 636 679 or emailing accounts@dementiasa.org
Should a product purchased be unavailable, the seller, Dementia SA, must notify you and issue a full refund within 4 weeks after such notice.
Defective / damaged productsif Dementia SA supplies the wrong product or if the product is damaged or faulty as a result of a manufacturing defect, Dementia SA must be notified by email to accounts@dementiasa.org or by contacting the National Helpline 0860 636 679, within 14 days of invoice. Should Dementia SA not receive notice within such 14 days you will be deemed to have received the correct product, in accordance with the order placed by you, and in good working condition.
Dementia SA will exchange the incorrect or faulty product for a replacement upon receipt of the returned product.. The returned product must be received in the original packaging and if the product is returned as a result of being an incorrect delivery, the product must not have been utilised. Dementia SA will make all reasonable effort to exchange the product, but if replacement is not possible at the same price or at all, Dementia SA will refund the purchase price including delivery cost upon receipt of the returned product.
Stock shortagesIn the event that Dementia SA is out of stock of the product ordered by you, Dementia SA must notify you thereof, whereupon - in the event of a temporary out-of-stock situation, you shall be entitled either to cancel the order and be fully refunded, or to maintain the sale subject to a later delivery date as may be agreed;
in the event of a permanent out-of-stock situation, you shall be entitled to be fully refunded.
In being 'fully refunded' as aforesaid, you will be refunded the relevant purchase price and delivery charges, without having to pay any administrative or other charges.
3. Privacy Policy
We recognise your need for appropriate protection and the careful management of the personal information you share with us (any information by which you can be identified, such as name, address, and telephone number). The Dementia SA website is entirely safe and easy to use and offers the secure communication you expect.
Your information will never be disclosed to third parties. Your submitted details will only be used by us to thank you for your donation and facilitate your payment for training courses, donations and online shopping of displayed goods. The only use of your information would be to send you our newsletter - if you have opted for it of course.
Furthermore, we guarantee the security of your payment and contact details you submit to our pay portal. Currently, payments are done via EFT and therefore no banking details are made available through cyber space. We also accept VISA and MASTERCARDS. We charge a R45 surcharge for any cash deposits and if international transfers are made we do NOT accept any bank charges - the purchaser is responsible for ALL bank charges. The full amount, void of any bank charges needs to be transferred into our account.
You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your personal information we are entitled do so.

4. Product Sales
All products displayed on this site are subject to availability and will be delivered only within South Africa unless otherwise specified and agreed upon by Dementia SA in writing. International courier or postage fees will then apply. All prices displayed on the site are quoted in ZAR and are valid and effective only in South Africa. Dementia SA reserves the right without prior notice to discontinue or change specifications on products and services offered on this site without incurring any obligations.
5. Donations via Website Pay Portal

This means that all donations to Dementia SA are tax deductible in South Africa under the provisions of Section 18A of the Income Tax Act. All donors in South Africa donating amounts larger than R100 will be issued with a Section 18A tax certificate which can be submitted with their annual SARS return.
6. Disclaimers and Exclusions of Liability
Dementia SA shall not be liable for any loss, damage (whether direct, indirect or consequential) or expense of any nature whatsoever which may be suffered as a result of or which may be attributable, directly or indirectly, to the use of or reliance upon this website (including any information contained thereon) or the internet.
